General rules for accessing and using the Pilotia platform for Company, Expert and Vendor profiles.

1. Purpose

These General Terms of Use (“GTU”) define the rules for accessing and using the Pilotia website and platform, operated by Pilotia.

They apply to visitors, account holders and users of the spaces, content, features and services offered on Pilotia. Paid or specialised services may be subject to specific terms which prevail over these GTU in respect of their own subject matter.

2. Definitions

Platform: the Pilotia website, its connected spaces, content and features. User: any person accessing the Platform. Account: a personal space created to access certain features. User Content: any information, document, profile, comment, offer, contribution or data submitted by a User.

3. Acceptance and enforceability

Where an acceptance checkbox is presented during registration, subscription or use of a service, the User must read and accept the applicable version of the GTU before proceeding. The date, version and technical elements of acceptance may be retained as evidence.

Access to public information pages does not, in itself, constitute a waiver of any mandatory right. However, use of an account or service requires compliance with the applicable rules brought to the User’s attention.

4. Account creation and security

The User provides accurate, complete and up-to-date information. They protect their credentials, do not allow an unauthorised third party to use their account and promptly inform Pilotia of any unauthorised access or compromise.

Each User is responsible for actions performed from their account, unless they prove fraudulent use that is not attributable to them.

5. User profiles and available services

Pilotia currently offers three main categories of profiles. The services actually available may depend on the role, assigned rights, prior validation, the Platform’s stage of development or a subscribed offer.

Company Profile

  • Access to restricted publications and resources according to account permissions.
  • Access to expert profiles when this feature is enabled.
  • Download of documents and resources made available.
  • Publication of mission opportunities when this feature is enabled.
  • Requesting a demonstration or introduction relating to an EPM solution.
  • Access to comparison tools, diagnostics or paid services according to the subscribed offer.

Expert Profile

  • Creation and management of a detailed professional profile.
  • Uploading a CV and presenting professional experience.
  • Viewing and responding to mission opportunities when this feature is enabled.
  • Access to restricted publications and resources according to account permissions.
  • Contribution to discussion spaces, ratings or content where authorised by Pilotia.

Vendor Profile

  • Creation and management of a profile representing a software vendor.
  • Proposal or updating of information relating to an EPM solution, subject to validation by Pilotia.
  • Responding to contact or demonstration requests transmitted by the Platform when this feature is enabled.
  • Access to restricted publications and resources according to account permissions.
  • Editorial contribution in spaces expressly opened to vendors.

6. Changes to features

Pilotia may add, modify, suspend or withdraw a feature, particularly where it is experimental, little used, technically obsolete, exposed to a security risk or incompatible with the Platform’s development. A paid service must not be deprived of its essential substance without a reasonable solution.

7. General obligations of Users

Users undertake to comply with the law, third-party rights, the confidentiality of information received and the rules of professional courtesy. They must not engage in identity theft, fraud, harassment, dissemination of unlawful or misleading content, interference with a system, unauthorised automated extraction, spam, abusive data collection or circumvention of security measures.

8. Information, profiles and published content

The User remains responsible for the information and documents they publish. They warrant that they have the necessary rights and authorisations and undertake not to present content as certain, official or verified when it is not.

Pilotia may review, correct the form of, request supporting evidence for, refuse, unpublish or moderate content where it is manifestly inaccurate, unlawful, excessively promotional, contrary to the editorial policy or liable to infringe the rights or security of a third party.

9. Vendor Profile and information on solutions

The Vendor Profile allows an authorised representative to propose or update information relating to a solution. Creating a Vendor account does not confer any right to control Pilotia’s independent analyses, scores, rankings, reviews or content.

Pilotia retains editorial control over its pages, comparison tools, ratings and methods. Information submitted by a vendor may be verified, summarised, refused or supplemented with separate sources.

10. Introductions and relationships between Users

Where the Platform facilitates contact, a mission, a demonstration or a collaboration, each party remains responsible for its own checks, negotiations, commitments and obligations. Unless otherwise agreed in a separate contract, Pilotia is neither an employer, a general agent nor a party to the contract concluded between Users.

Any applicable financial terms or commissions are subject to specific information or agreement.

11. Paid services and specific terms

The prices, durations, quotas, payment terms and rights of use of a paid service are specified in the corresponding offer and specific terms. For EPM Scan Pro, the specific EPM Scan Pro terms prevail over these GTU in the event of a conflict relating to that service.

12. Pilotia intellectual property

The Platform, its structure, software, texts, trademarks, databases, methods, comparison tools, assessment grids, reports, visuals and content produced by Pilotia are protected. No transfer of ownership is made to the User.

Unless authorised in writing, substantial reproduction, resale, white-label use, database extraction, scraping, reverse engineering and use of content or methods to create or supply a competing service are prohibited.

13. Limited licence for User Content

Solely for the purposes of hosting, displaying, moderating, facilitating contact and providing the requested features, the User authorises Pilotia to reproduce, technically adapt and communicate their User Content for the period necessary to provide the service. This authorisation is non-exclusive and limited to the purposes of the Platform.

14. Links, vendors and third-party services

The Platform may present links, logos, information or services from third parties. Their presence does not constitute a guarantee of availability, compliance, performance or suitability. Third-party trademarks and content remain the property of their respective owners.

15. Availability and security

Pilotia uses reasonable means to ensure the operation and security of the Platform, without guaranteeing permanent availability, the complete absence of errors or compatibility with all equipment. Interruptions may occur for maintenance, security, incidents, force majeure or dependency on a third-party provider.

16. Liability

Pilotia is liable for direct and foreseeable damage resulting from a proven breach of its obligations, within the limits permitted by law. Pilotia is not responsible for decisions, statements, content, commitments or failures attributable to a User or third party, or for indirect losses such as loss of opportunity, margin, reputation or expected savings.

The limitations provided for in these GTU do not apply where prohibited by a mandatory provision, in particular in cases of gross negligence or intentional misconduct or bodily injury.

17. Personal data and cookies

The processing of personal data is described in the privacy policy. Cookies and trackers are described in the cookie policy and in the consent management tool where required.

18. Account suspension and deletion

Pilotia may suspend or delete an account in the event of fraud, a security breach, a serious or repeated violation of these GTU, applicable non-payment, unlawful content, misuse or a serious risk to Users or the Platform. Except in an emergency or in the case of an irremediable breach, a reasonable opportunity to remedy the situation may be granted.

19. Evidence

Technical logs, account data, login histories, forms, correspondence, timestamps and acceptance records retained under reasonable conditions may be used as evidence, unless proven otherwise.

20. Changes to the GTU

Pilotia may amend the GTU to reflect changes in the services, risks, regulations or its organisation. The date and version are indicated on the page. Where a change substantially affects an account-based service, Pilotia may request renewed acceptance or inform Users by an appropriate means.

21. Governing law and disputes

These GTU are governed by French law. Any complaint must first be submitted through the Pilotia contact form in order to seek an amicable solution.

PROMINENT CLAUSE — BETWEEN PARTIES ALL OF WHOM HAVE CONTRACTED IN THE CAPACITY OF TRADERS, ANY DISPUTE RELATING TO THESE GTU SHALL FALL WITHIN THE EXCLUSIVE JURISDICTION OF THE PARIS COMMERCIAL COURT, SUBJECT TO ANY CONTRARY MANDATORY RULES.
